Even though new, reported cases over time will show that the Andersons' case changed the law in Maryland, they were denied any and all benefit of the decision and the Court basically screwed them over, royally by merging the Deutschebank entities and falsely stating that the Andersons acknowledged that one of these entities held the original documents. The Maryland Amicus Court Review published this nonsense hook, line and sinker p. 5. Read the Motion for Reconsideration as filed, below. Here then, is the cryptic decision and the order of costs to boot:

"They lied to the Bankruptcy Trustee and to the Court.... It was just a servicer at the onset, Saxon. Deutsche was nowhere around.... There are two different Deutsche entities, after a while they claimed it was Deutsche America -- but it wasn't.... They then filed a bogus allonge some 9 months later, saying it was Deutsche National.

"Now they have already sold the house and ratified this, but they have made the same mistake all the other courts have. The Court of Special Appeals and the next court have both issued wrong opinions, so they are going to have to address that. We've got them all in a box, they can't issue contradicting affidavits in BK and in the Court of Appeals."

Does anyone remember how I sent several Vericomm/MBF Leasing victims in NH to then-AG Kelly Ayotte's Office with their valid complaints that involved bait-and-switch, forgery, unconscionable rates, fraudulent inducment and fraud in the factum? Well in case you don't I preserved these matters for inspection, often with copies of the actual documents involved. This is the best example, showing how the scam works: Journal Entry 17 April 2007.

They fold over the top page of the lease and the merchant never really knows what they are signing up for. Merchant Point of Sale is an excellent resource and they report that the Chittur firm won a victory this year in that the subsequent pages of the lease are invalid.

The video above is from related ABC News coverage. And here is some courtroom footage from the case of Pludeman v. Northern Leasing, which is still forging ahead as a class action nightmare. As it turn out, these scumbags are basically white collar thieves, IMO, operating in concert with Kelly Ayotte campaign contributor Goldman Sachs! Read this November, 2010 Rip-Off Report very carefully. Now it all comes together rather nicely, doesn't it? Here is a September, 2006 Rip-Off Report on Vericomm for Good Measure.

No Building exist[s] within so-called moved location at 35 E Wacker place, Chicago Illinois after they had a run in with a State Representative, they also los[t] their lease for noon payment of over $401k in back rent at the 233 North Michigan Ave address which was pending in local district court currently.....

....They also have corporations under other names, are tied into banks, insurance companies all over the nation. And they were sued for the issue of consumer fraud in the state of New York and Missouri by the Attorney Generals within those states. All Better Business Bureaus have complains on file against them concerning the same complains and in Illinois alone they have a total of 760 filed to date (July 2010)

The game is moving these non-cancellable leasing into the hands of ICON Leasing Fund Eleven LLC which is a 35% owner of Northern Leasing and formed also 52.75% for which they have ownership interest in ICON Northern Leasing, LLC they in turn take the leases at and interest rate of 18% and then trade-in as credit derivatives using one company called Goldman Sachs.

These people make me so sick I could just barf. They -- and not the so-called "illegal aliens" are at the core of what is truly ripping America apart. Watch me question Kelly Ayotte's BFF Joe Arpaio on this in this movie. Sure some undocumented workers scam the system, that's undeniable. Some don't even come here to work but most do, and most of them work at jobs that most Americans won't. Furthermore, there are plenty of blue-collar Americans who scam the system as well, but the most damage by far is coming from the white collar sector.

Note the Kelly Ayotte allegiance to big banks as noted in the thumbnail here and in the "Goldman Sachs booed at NYC Freedom Fund Gala" journal entry, where she also acknowledges the fact that her office never investigated the forgery of my name to a mortgage. Not to mention the FRM Ponzi scam, yet another mortgage-related scam that Senator Ayotte allowed under her auspices -- it was the largest consumer fraud in NH history and the resigned chief NH Securities inspector Mark Connolly wrote a book about it after her alerts were deemed "faulty." Alerts? There are no alerts, this chick is in on the Game sure as I'm sitting here writing this journal entry. She and these banks represent the downfall of Western Civilization.

Meanwhile in Rhode Island at least Judge John J. McConnnell had the Good Sense and moral fiber to suspend the bogus, no-standing, illegally-securitized fraudclosure cases in his Jurisdiction, while Kelly Ayotte and NH Bankruptcy Trustee Lawrence Sumski allowed banks to run amok in Superior Court and in BK on the B10 claims. Sumski is Bad News.

Well KingCast, what if any of these losers sue you for Defamation?

Ralph Holder. Michael Holman. Dave Coltin. Mike Puiia. Joshua Yousseff. What do these men have in common? I celebrated the arrival of this journal last October and will provide hotlinks for each of these examples later this morning, but basically they or their immediate families have all had child visitation rights stripped from them by the unlawful New Hampshire family court division. Sometimes there is even retaliatory action, as Mr. Holder alleges that Deputy Sheriff Jack Hannigan and Kelly Ayotte/NH AG lackey Mike "MIA" Bahan conspired to fabricate domestic endangerment case on him. I've seen the evidence and he's probably right. Hannigan, for his part, went on to be suspended for something else, as seen at right. In New Hampshire the wrongdoing only matters when certain people in power are harmed, though.

Each time something like this goes down, arbitrary and capricious findings and orders are enforced based on complete lies, destroyed or false evidence and contrary to basic legal principles that go back to Brown v. Board of Education and Palmore v. Sidoti. In Mr. Yousseff's case there was never a finding that he was an unfit parent. I have chosen my words carefully in describing that legal entity. Here is last week's hearing before the NH Legislative Redress of Judicial Grievance Committee. I couldn't be there but thankfully someone else was. You may remember that committee: KingCast cameras were there late last year to follow the Marie Miller/NationStar fraudulent foreclosure case, in which the entire structure of New Hampshire's Judiciary was questioned after NationStar was allowed to defy a clear cut Court Order and law of the case, which held that they had to provide the original note and mortgage. Even I had to testify in that one, read this journal entry and review the entirety of this open letter to U.S. AG Holder and NY AG Schneiderman. Yesterday I compared and contrasted the Rhode Island/Judge John J. McConnell's process with that of New Hampshire and the difference is night and day.

So there you have it. New Hampshire will take away your children and your house without Due Process of Law as it gives you the ultimatum "Live Free or Die," a nice touch n'est-ce pas?

I commend you for your Order and Moratorium on dozens of Rhode Island foreclosure cases. Unsettled title issues and outright mortgage fraud in the the inducement, factum and foreclosure are ruining this entire country as I have made clear in my Mortgage Movies Journal Entry and open letter to AGs Holder and Schneiderman. Your approach to the situation acknowledges that there is something wrong, yet in New Hampshire the very same people who tried to vote you out of ascension to the Federal Bench turn a blind eye to mortgage fraud, even now as I provide them with a copy of the actual mortgage on which my signature was forged pursuant to my own endeavors to locate the document.

Eight (8) long years have passed since I informed NH AG cum U.S. Senator Kelly Ayotte of this issue, despite countless visits to her Washington and New Hampshire offices. Watch the videos (Capitol + New Hampshire): I am polite, polished and quite respectful each time, and each time I come away with nothing but promises. In that time we have also seen her systems declared faulty in the FRM Ponzi scam, the largest consumer fraud in New Hampshire's history. Former NH Securities Chief Mark Connolly wrote a book about it. By the way that Seacoast Online story is written by Elizabeth Dinan, who was sexually assaulted by NH LE Fred Hoysradt, who got off with a slap on the wrist under AG Ayotte. Be that as it may, you can see her promise to refer my complaint in the Nashua Town Hall video from last fall, yet and still nothing has happened. The Nashua Police Department is similarly afflicted with feet of clay (watch the movie and non-response from Lieutenant Alex Gorman) and silent repose as Senator Ayotte counts her money from Goldman Sachs and Bank of America -- two of the dirtiest culprits in this entire fiasco.

Your Honor, I respectfully assert that this is not about the law. This is about the Republicans getting away with anything they think that they get away with, and the same message rings loud and clear in the pending KingCast v. Ayotte, GOP and Nashua PD Free Press litigation currently before you, NH Dist 2010-CV-501. These are bad people doing bad things, in turn supporting other bad people who do bad things, and it is coming from the new Republican nerve center. I don't completely understand it, as I have Republican friends who are quite reasonable and who supported me over Kelly Ayotte as seen in the bogus criminal indictment she obtained against me as NAACP Legal Chair. Then there is the blatant coverup of the Franconia shooting tragedy involving Greg Floyd, Liko Kenney and Norman Bruce McKay. In that, she had access to Greg Floyd's legal background as described in Easton Police Chief Robert Every's Affidavit (view using full screen button) indicating that both he and the neighbors (specifically citing Alma Jean Boisvert) were terrified of Greg Floyd because he had been shooting his guns in violation of 18 U.S.C. 922(g)(1) and he was "likely to show up at Lafayette school with a loaded gun." Ayotte gave him a pass in what I believe to be the murder of Liko Kenney in 24 hours and sure enough, Alma Jean Boisvert would subsequently be victimized by him as he was convicted of gun threats immediately after shooting Liko Kenney. Frankly, I don't know what is going on in New Hampshire, but I knew enough to leave it, and to only return to visit or to help others in need. That is a very progressive way of thinking, and it is something that New Hampshire wants nothing to do with. Perhaps such is the difference between a Case Western Law graduate and a Villanova Law graduate.

Okay so first up come the slimeball attorneys at Suttell & Hammer getting a little pro se beatdown, love to see it. It appears that they got caught up in some sort of Citibank consumer credit/FDCPA action out in Washington and had to dismiss the case. The victims inform that they never even got a copy of this until they went down to the Court to hunt around. Frankly it doesn't surprise me and I hope they sue for damages. I know Citi attorney Sam Shaulson got away with bloody murder in a case in which I was involved when they dishonored a valid check, so I have to laugh now that their lies are being exposed on a much grander scale than I could ever hope to achieve on my own. Ha. Ha.

Next up, remember the KingCast/Mortgage Movies open letter to AGs Holder, Schneiderman and HUD Secretary Donovan? Well that ties in nicely with the pending litigation that AG Schneiderman filed against Bank of America, Wells Fargo and JP Morgan -- the same banks that New Hampshire pols and judges coddle daily, right in front of my cameras. The study has two parts. One used data from actual bankruptcy cases from the Consumer Bankruptcy Project, the most detailed trove of information on filers currently available. The project surveyed 2,400 households nationwide who filed for bankruptcy in 2007.

Results from the second part of the study, which illustrated the lawyer’s influence in determining which bankruptcy chapter to choose, came from a survey sent to lawyers asking them questions based on fictitious couples who were seeking bankruptcy protection. When the couple was named “Reggie and Latisha,” who attended an African Methodist Episcopal Church — as opposed to a white couple, “Todd and Allison,” who were members of a United Methodist Church — the lawyers were more likely to recommend a Chapter 13, even though the two couples’ financial circumstances were identical.

First of all how can YouTube continue to show 309, or 1/10th of the hits I got for the video, "Foreclosure Fraud: Judge and Bankster Caught on Video, Juan B. Colas, Anchor Bank Pt.1." when the graph clearly shows something in excess of 3,000 hits on the video's first day. Now on Wednesday morning 11 Jan it says 2,184 when the YouTube graph clearly shows 3,300 or so, how niggardly.

Similarly, New Hampshire cannot stand to have certain issues publicly aired so they change the rules and coverup, just as did Judge Juan Colas when I journeyed to Madison, Wisconsin yesterday. That is why New Hampshire recently reneged on its Open Court policy with respect to video cameras in Cheshire County, the same place where I had to stomp some heads back in 2006 and where Thomas Ball committed suicide by fire in 2011. The NH Supreme Court recently changed the policy to create a heavy First Amendment presumption in favor of open media access in 2007 if I recall correctly, now Judge Tina Nadeau took it all away in one pen stroke in the Supreme Act of spot zoning.

There was a complete no-show on the hearing scheduled today but no one told the Counter-Plaintiff. The Bailiff/Clerk or Session 8 told us on video that they tried to reach him but that's completely unbelievable because his name and full contact information is of course on file with the Court. He alleges that the same thing happened when Anchor Bank was granted receivership, now I believe him given what I witnessed today. Frankly the U.S. Justice Department should step in because this is ridiculous. I had a brief chat with Judge Colas and another chat Anchor Bank President and COO Mark Timmerman pictured, above (not certain if he still holds that position, see the graph at bottom) at the Executive Office of Anchor Bank. Here is your back story on how Anchor Bank and Union Federal have basically stolen money from Mr. R.P. with the express and tacit approval of Dane County Circuit Court Judge Juan B. Colas, pictured at top. My question to him, and to the folks in the executive office at Anchor Bank is simple:

Here is the story at Stopforeclosurefraud. As a First Amendment scholar who has never lost a gag order issue, I love this. I absolutely love it. When U.S. District Court Judge Jerome B. Simandle slammed the spurious gag order request of Phelan, Hallinan & Schmieg in the Charles Giles class action case, he slammed the same dirtbag jackass lawyers who called the police on an innocent homeowner and indie journo, only to have the police take the side of the homeowner, i.e. "We don't know WTF is going on here because no one is answering the door!"

Note further that despite the urgings of his intern as heard in the movie, Senator Menendez's Office has refused to speak with the homeowner or me about what happened that fateful day, nor has he responded to my FOIA request for the information gleaned from regulatory agencies when Menendez, Al Franken and eight (8) other Senators demanded information from said agencies. I'll download the full documents later but for now read Plaintiff's Opposition Motion p2 below and 3 above, calling attention to the cozy connection between Kenneth Phelan as name partner and as Fannie Mae Chief Risk Officer as government investigations revealed a need for tighter scrutiny over "foreclosure abuses," ahem. Note: I reminded the Court that I should have been able to file my Third Amended Complaint for actions Defendant Ayotte and Nashua PD committed after I filed my Second Amended Complaint. My case has only been around one (1) year but His Honor allowed an Amendment after two (2) years in TG Plastics v. Toray Plastics, 2011 U.S. Dist. Lexis 81122.

Note: Judge John J. McConnell took the matter under advisement and will issue an Order, I would guess prior to the New Year. He is the visiting Judge from RI after I scared all the NH Judges into recusal..... but I guess I'm not entitled to know why they all scurried so even though I only moved to recuse Magistrate Judge McCafferty, a Motion to which former sitting Judge Paul Barbadoro initially held was "entirely without merit." Right.

I quoted Justice Rehnquist who noted that allowing black reporters to attend the publicly-advertised KKK rallies in NAACP v. Thompson does not amount to a Fifth Amendment Constitutional taking, as the Defense Counsel almost fooled the Court into believing, before I took the microphone. Read it right here at 648 F. Supp 195 (1986).

Writes Holder: You made an excellent point that in one instance you were actually invited to appear. Given my law enforcement experience, I believe the police had more than a cursory responsibility to determine exactly why you were be asked to vacate public or commercial property , as opposed to private premises, for trespass. They owed you a duty to determine why? They gave the force of law to someone's private biases and prejudices.

I noted that this case does not occur in a vacuum, and that these are not truly private events because you have a former AG running for U.S. Senate, along with paid advertising to the General Public. Let me tell you what these events are not: These are not GOP strategy sessions. These are not Communion afterparties. Nor is it my GF's son's Bar Mitzvah. At those kinds of events of course you can pick and choose to throw any media you want to out if they show up. But given this context in a National election to an election that is exceeded in importance only by the Presidential Election, the Court is free to say that the Bright Line Standard allegedly sought by Nashua PD Counsel Brian Cullen lies somewhere south of the Grand Ballroom at the Crowne Plaza, but north of Kelly Ayotte's personal home given these publicly-advertised events.

In voluntarily dismissing my public accommodations claim (I didn't file administratively) for when Nashua PD continued to harass me after I had left the leased GOP/Joe Arpaio area the the Crowne Plaza I told the Court: "The larger issue is the fact that they continue to bother me at Crowne and at the VFW John McCain rally even though I was following their instructions. At that point you have to leave me alone, let me do my job and just shut up.... and every time they bothered me Your Honor they were trammeling my First Amendment Rights as a journalist to gather news and to write my story."

And I know more than a bit about unlawful use of Police authority both as a former AAG and in private practice, in Isreal v. Roades and Hensley I got those LE busted for making my client a victim of violent crime, V96-61481.

And I reminded the Court that the rationale for not allowing me into the Joe Arpaio "steak out" public invite rally shifted, and shifting rationale is but one way to show that the proferred legitimate nondiscriminatory rationale is pretext for racism. First I was allowed in explicitly as a journo by Defendant Di Lothrop and Defendant Dennis Hogan, Nashua Republican Committee Chair who is also County Attorney. He knows me well. Then Defendant Ryan Williams informs me that I am not a journalist then Di Lothrop does a 180 and says "you are not a member of the media" and THEN she says "this is a private event."

I says they are full of it. Watch the movie, it doesn't lie. But they do every time they open their mouths.

Also I noted that an RSVP to the VFW John McCain/Kelly Ayotte and my acceptance constitutes thereof constitutes a contract pursuant to 42 U.S.C. §1981 (which must be applied and construed liberally as a remedial Civil Rights Act) and that it is impossible for me to have more proof of racial animus on than what I have at this point because I have not yet had any discovery. For all I know the Republican policy on indie media is to let all of us in. Now if they are breaking with policy the trier of fact could find racial animus. Also Kelly Ayotte's past actions toward me as an AG might not be actionable under prosecutorial misconduct rubrics but they can still be probative of racial animus, particularly when coupled with the fact that she now continues to lie to me and to avoid doing anything about the forgery of my name to a mortgage even though she says in video that she would do something. (More coming Tuesday morning).

I reminded the Court that Kelly Ayotte and her Chief of Staff John Easton lied in collecting public money to defend this litigation by stating that I had filed frivolous lawsuits, which is actionable in and of itself.

I reminded the Court that Nashua PD blew it on application of Trespass laws against indie journo Dave Ridley and private citizen Mike Gannon in light of Glik v. Boston.

Addendum: On further review, these are some precious photographs. Wait until you hear what folks are saying in the video. The Big Dog lawyers, including NH Bar Association President Jennifer Parent, all scooted out the side door, I figured as much and they made their front door sortie on Dave Ridley video already anyway, as noted in a link I will soon post.

And I thought I had it rough because U.S. Senator Kelly Ayotte and Nashua PD merely refuse to investigate the forgery of my name to a mortgage, watch the short film. Anyway from Reuters:
She had pleaded guilty to falsely notarizing Trafford's signature, affixing her official stamp to his signature even though he wasn't present. Lawrence was due to be sentenced Monday on the single count, and the attorney general's office had agreed to support her lawyer's request for probation. But Lawrence failed to appear in court for the sentencing. The attorney general's office called the police, who went to Lawrence's apartment and discovered the body, Las Vegas Police Sergeant Matthew Sanford confirmed.

Sanford said in a phone interview that the death "currently is not being investigated as a homicide." He said the cause of death likely won't be known until completion of toxicology tests by the country coroner, which would take several weeks.

I got a call from the U.S. Attorney's office for Delaware yesterday and they're notifying the FBI to pick-up their investigation efforts. Apparently, the U.S. Attorney's office can't bring criminal suit without completion of the investigation by the FBI. I'd better get my class-action suit in before this gets taken over.

Here is the Occupy for Occupation website. Much more on this later today with color commentary and quotes but I can tell you this much: The 250+ people in attendance last night mean business, and they are very well organized, contrary to rumors spread by much of the major press. HuffPost writer Allison Kilkenny and I were next to each other and we were both very impressed. They've got legal, media, electronic, tactical and all matter of committees working together. They count the hundreds of unoccupied buildings in the City and highlight the fact that the homeless shelters that were full 25 years ago are now twice as full. Their chant is real: "Oh-Four-Oh is ready to act... we see you... and we got your back!"

Also, I hear the Baum Law Firm is engaged in massive layoffs, let's hope they completely fail and that some of their snooty, self-righteous staff wind up upside down in their McMortgages and totally homeless, ahem.

Anyway last night I had a brief but rather engaging conversation over a drink with a certain one percenter who will remain nameless but who definitely does not fit the mold of the archetypical one percenter. That fact is important for several reasons: This individual is no silver-spoon dilettante. S/he grew up working jobs and slinging burgers just like us 99%ers but at some point had the luck and foresight to get involved in alternative/green energies well ahead of the curve. In point of fact I have no doubt that our Kevin Bacon paths have crossed at some point when I was zoning director for a certain wireless infrastructure company 2 years ago in New England. They too, embrace green technologies. We both concur that identity politics is one of the most divisive and useless things this Country has ever seen: It is equally unfair to prejudge all of the Occupy protesters as it is to prejudge all corporate executives.

"What if my family had decided to hate all white people just because some white people were jerks," I pointed out. "That would get us nowhere and I would have less diversity in my family to boot."

I raise these issues today because this one percenter was keenly interested in learning more about the mortgage crisis, mortgage-backed securities, municipal and State CAFR accounts and the illegality of securitized notes that provide the backdrop for much of what is the subject of the protests, ab initio. Just ask NY State Judge Arthur Schack, AZ Bankruptcy Judge Eileen Hollowell and Judge Christopher Boyko from my former Federal practice venue when I was AAG and in private practice, prior to becoming a title insurance producer.

There are corporate executives in my own personal life who are open to learning about these issues as well. The bottom line is that those of us interested in crafting a better World must remember to stay open and to work together out here, otherwise we are destined to stay stuck on stupid, Five Gears in Reverse. Just ask this one percenter, who supports the Occupy movement. But don't ask U.S. Senator Kelly Ayotte, she is obdurate in her support of the corrupt one percenters. Watch this:

It appears that Union Federal Bank has jumped the gun in making Randy _________ tenants fork over money to them just because they filed a foreclosure action. As I will note in today's movie from the Courthouse, the case law I have seen researched holds that they have to have a hearing first, especially in a State that has not ratified the Draconian Universal Assignment of Rents Act (UARA). And the Court has allowed it to happen, thereby violating this mans Substantive and Procedural Due Process Rights..... Time to check the CAFRA Accounts, right. Today comes the Courtroom. 2:38p update, she won!

Watch late night tonight to see the 11th hour Withdrawal of both Nationstar/Harmon Law Motions, i.e. the Writ of Possession and a forfeiture issue on a bond. So as I understand it, that leaves an active Judgment for Possession that came out of nowhere, given the paucity of proof. "We're off to see the Wizard," I wrote my GF this morning...... Indeed I was. And Harmon Law -- a regular reader of this journal -- made a cameo as the cowardly lion.

Sunday 8:50p update: The following paragraph is apparently a lie. After we all left Ms. Miller went back inside to fill out the W9 form or whatever and was told that her Motion for Clarification reopened the case and that she would not then get the money tendered back to her. But that sounds shady because all she asked for was clarification to make certain that the withdrawals were with prejudice. So if she was "reopening the case" that doesn't make any sense because all the clerk had to do was tell her "no need we will issue a notation that the withdrawals were with prejudice" or words to that effect. The Clerk then told her that they were going to go ahead and foreclose on her anyway, which would make the whole thing appear to be nothing more than an attempt to keep KingCast and Mortgage Movies cameras away from the Action. Sousa v. Wells Fargo Bank, N.A. 2011 BNH 3. Wells Fargo and their attorneys failed to provide buyers copies of their closing documents and tried to refuse a rescission. The Decision came down earlier this year, around the same time that he was busy taking a piss on me for being Leslie Crepeau's "Internet Cohort." Now remember the difference is that Ms. Crepeau and I were going at things on a much deeper level and a mere rescission for failure to provide documents. We were going into the belly of the beast, the CDO Fraud, the securitized mortgages, the inherent lack of standing.... that sort of thing. Watch the movie up top. Here is the case at Stop Foreclosure Fraud because Lexis doesn't like it too much when you publish their cases. I figured that out when I was highlighting all of the successful Defamation litigation against the Boston Herald.

At any rate, or be that as it may, a Lexis search still fails to reveal proof that Trustee Lawrence P. Sumski has ever gone after a B10 proof of claim against the big banks, which is probably why he and his lawyers are fighting me so hard on a simple FOIA Request that I have now appealed along with a question to Mass AG Martha Coakley on her approval of 12% check cashing fees at Band of America and what her office does with the mortgage fines she takes in every year. You know, stuff that should be readily available for the public to know about, right? At any rate, or be that as it may again, I did find this interesting case of consumer abuse where Chase Manhattan and Federal Home Loan Mortgage tried to foreclose because there was a $3.42 discrepancy in the check amounts! Read below the fold to see how Judge James E. Yakos blasted Chase in McCormack v. Federal Home Loan Mortg. Corp. (In re McCormack), 203 B.R. 521.

This chapter 13 bankruptcy case was filed on May 17, 1991 for a plan with creditors by the debtor. The relations between the debtor and Federal Home Loan Mortgage Corp., acting through agent Chase Manhattan Mortgage Corporation (hereinafter "Chase") got off to an immediate rocky start......
.....when the secured creditor, Chase, [**3] authorized its attorney to file a motion for relief from stay because certain checks tendered by the debtor were $ 3.42 off his regular monthly payment to Chase. This led to some ill will on the part of the debtor since he was then faced with attorney's fees, costs, and possible foreclosure for a relatively small amount of discrepancy in the payments.

The testimony by Chase's witness that its software at the time would not accommodate separate accounting and recording of payments coming from the trustee under the plan I find amounts to the "computer did it" defense. That defense is a nonstarter in this Court's judgment since intelligent beings still control the computer and could have altered the programming appropriately. ² SeeIn re Price, 103 Bankr. 989, 992 (Bankr. N.D. Ill. 1989); and In re Stucka, 77 Bankr. 777, 783 (Bankr. C.D.Cal. 1987). To paraphrase the old quote "garbage-in" adage a version here pertinent would be "contempt-of-court-in" and "contempt-of-court [**10] out."FOOTNOTES

2 Although perhaps below their dignity and customary practices Chase employees were not precluded from getting a quill pen and ledger book to keep track of the effects of a chapter 13 plan in progress if indeed it was beyond the powers of mortal men and women to re-program their computer.
The actions by Chase in this Court's judgment deserve the imposition of punitive damages in this case. Chase acted with clear knowledge of the bankruptcy, the plan, and the confirming order and acted deliberately in a manner contrary to those requirements, knowing that it was violating federally protected rights, or at the very least acting with reckless disregard as to whether it was doing so. Cf. In re Wagner, 74 Bankr. 898, 904 (Bankr. E.D.P.A. 1987).

Screw these guys anyway they are paying $2M for fraudulent conduct in the first place as seen above via US AG Preet Bharara. Read today's NYTimes Op-Ed piece "What the Costumes Reveal" by Joe Nocera. I wrote him today and I will pay a visit to the Baum Law Firm, the same firm that the U.S. Trustee slammed for false documentation just like the rest of the foreclosure mills. Heck M&T bank administers the pension funds for MD try getting a fair shake there against someone like Thomas P. Dore, search his name on this journal more on that soon. But the way these big firms treat solo attorneys and their contempt for them, I know it well because I have had big shot lawyer Luis Alcalde stick his stubby little fingers in my chest to goad me into a fight after a Depo. I wisely passed on that but you can read more about him in the No Child Left Behind public information request.

OMG LOL! So it was you who said Todd is the white Marvin Gaye. I was listening to Black Maria, and that phrase popped into my head. Many times people of color are reluctant to embrace "white" musicians, even when those white musicians have a history of working with musicians of color.... and vice versa.
